By now, news of the Boca Raton attorney who has created signs that read “I remain silent. No searches. I want my lawyer.” to be used at DUI checkpoints has gone viral. This has many people wondering if such a tactic could be used in any jurisdiction across the country. Indeed, these signs are, according to their creator, intended to protect the right to remain silent while preventing police from making assumptions about sobriety based on smell or speech patterns. As such, they are not in violation of existing state laws and could, conceivably, be used in Maryland and throughout the country.
